1. These Terms and Conditions ("Terms") govern all sales and contracts entered into between the Seller ("I", "me", "Operator") and the Buyer ("You", "Customer") through lindabilska.com.

2. By placing an order or subscribing on this website, you agree to be bound by these Terms.

3. These Terms are prepared in accordance with applicable Czech legal regulations (Act No. 89/2012 Coll., Civil Code, and Act No. 634/1992 Coll., Consumer Protection Act) and European Union consumer legislation.

The shop offers the following categories of physical and digital products:

• Original Artworks: One-of-a-kind physical paintings and original creative works.

• Fine Art Prints & Paper Goods: Open and limited-edition fine art prints, postcards, greeting cards, wall calendars, books, art cards, and other printed stationery goods.

• Physical Snail Mail Subscriptions ("The Art of Becoming"): Recurring monthly mailings containing fine art prints, written companion letters, and affirmation cards delivered directly by mail.

• Digital Goods & Downloads: Digital companion story files (PDFs), phone wallpapers, e-books, and digital subscription access delivered electronically.

• Prices: The main shop operational currency is set to Czech Koruna (CZK). Prices may be displayed in the buyer’s local currency (e.g., EUR, USD) depending on their geolocation and currency selection at checkout.

• Order Confirmation: A binding contract is concluded upon receipt of an automated email confirmation following checkout.

• Payment Methods: Payments are processed securely via Stripe. We do not store or collect your payment card details.

• Subscription Payments: Recurring Snail Mail subscriptions are processed automatically via Stripe on the recurring billing schedule determined by your initial subscription plan.

Dispatch:

• Physical Products (Prints, Originals, Calendars, Stationery): Dispatched from the Czech Republic via Česká pošta or tracked delivery partners within 3–5 business days.

• Snail Mail Subscriptions: Snail Mail packages for a given monthly issue are dispatched on a rolling basis, with final dispatch occurring no later than the last calendar day of the following month. (For example: a December issue ordered on December 31st will be shipped no later than January 31st).

• Digital Downloads: Delivered instantly or via automated email links following payment confirmation.

• Commissions & Custom Work: Custom original commissions or bespoke orders are produced and shipped according to the timeline agreed upon directly between the artist and the customer in writing.

Carriers:

Physical packages are shipped from the Czech Republic via Česká pošta or tracked delivery partners.

Packaging & Safety:

All items are packaged securely to protect fine art in transit. Snail Mail packages use discrete envelopes for privacy.

Accuracy of Address:

Customers are responsible for providing correct and complete shipping addresses at checkout.

Statutory Right of Return (EU Customers):

• EU buyers have the right to withdraw from a purchase contract within 14 calendar days of receiving physical goods without giving any reason.

• To initiate a return, notify the Seller in writing via email before the 14-day window expires.

Return Conditions:

• Returned items must be unused, in their original condition, and safely packed in original (or equivalent protective) packaging.

• The buyer is responsible for paying return shipping costs. We recommend using a tracked postal service.

Refund Processing:

• Once the returned item is received and inspected, a refund for the item price will be issued to your original payment method within 14 days. Original shipping fees are non-refundable unless required by mandatory consumer laws.

Exceptions:

• Custom commissions, personalized items, or custom-framed works are non-refundable.

• Prepaid multi-month subscription packages are non-refundable once the first physical shipment of the bundle has dispatched.

• Digital Downloads: By purchasing digital downloads or digital subscriptions, you agree to immediate performance of the contract and acknowledge that you waive your 14-day statutory right of return once the file delivery or download link has started.

Subscription Cancellation:

• You may cancel recurring monthly Snail Mail subscriptions at any time through your customer account portal or by emailing support prior to your next automated billing date. Billed shipments already in queue will be fulfilled.

• If your artwork or print arrives damaged in transit or has a clear defect, please contact us via email within 7 days of delivery.

• Include clear photos of the damage to both the item and the outer packaging.

• Confirmed damaged or defective items will be replaced free of charge or fully refunded, including return costs if applicable.

Damaged Packages in Transit (Insured Shipments):

• High-value physical packages (Original Paintings, Large Prints, Framed Works) are fully insured.

• Important: If the outer packaging arrives clearly crushed, torn, or damaged, do not accept the package from the shipping carrier. Refuse delivery so it is returned under carrier liability, and contact us immediately.

Lost Mail Policy (Snail Mail & Small Stationery):

• Monthly Snail Mail packages and small stationery items are dispatched as standard non-tracked letters.

• If a letter or small paper shipment fails to arrive, it is generally considered lost in transit and will be replaced free of charge.

• Please allow 4 to 6 weeks from the official dispatch date before declaring a package lost, especially for international shipping. Contact us directly via email to arrange a replacement dispatch.

Non-EU Import Fees: Customers outside the European Union are solely responsible for any local import duties, VAT, or customs clearance fees levied by their home country.

• Copyright: Purchase of an original painting or print does not transfer copyright or reproduction rights to the customer. All images, artwork, letters, and site content remain the exclusive property of Linda Błasiak Bilska.

• Personal Use: Products are sold for personal display and collection only. You may not reproduce, scan, resell, or commercially exploit any artwork or written content without prior written permission.

• Written companion letters and diary entries included in Snail Mail packages are creative prose and artistic narrative. Names, locations, and details are generalized or altered to protect privacy. Any resemblance to real persons is coincidental.

• Content is for reflective and artistic purposes only and does not constitute medical, psychological, or professional advice.

These Terms are governed by the laws of the Czech Republic.

The Seller reserves the right to amend these Terms at any time. The version in effect at the time of your order applies.
